PartyClic
Terms of Use
GENERAL TERMS OF USE
These terms govern the use of the PartyClic website and service. The full identity of the publisher — company name, legal form, registered office, registration and contact details — is published on the “Legal Notice” page, which forms an integral part of these terms.
By creating an account or using the service, you accept these terms in their current version. If you do not accept them, do not use the service.
The terms of sale — prices, payment, right of withdrawal, refunds, cancellation of subscriptions — are set out in a separate document: the general terms of sale, to which these terms refer.
ARTICLE 1 – WHAT THE SERVICE IS
PartyClic is an online service. You send a photo from your phone or computer, you choose a scene, and an artificial intelligence produces an image of you in that scene. Everything happens in a web browser: the service involves no installation, no travel and no provision of equipment.
The result is an automated creation: it varies from one generation to the next and cannot be guaranteed to match a specific expectation. The service is available continuously, subject to the interruptions required for its maintenance and to failures of networks and technical providers.
ARTICLE 2 – THE OFFERS
For individuals: a free trial, whose photo bears the service’s logo; logo-free photos offered when you create an account; the purchase of a single photo; and no-commitment monthly subscriptions, expressed as a number of photos per month. Unused photos from one month are carried over to the following month, up to one month’s worth of photos, for as long as the subscription lasts.
For event organizers: an event is created from the console, funded with credits, and opened to guests through a link or a QR code. Photos taken during the event are collected in its gallery, which the organizer shares and whose content the organizer can download. An event’s credits are consumed by the generations made in it. Credits are held in the reserve of the organizer’s account, and the organizer allocates them to each of their events. Lowering an event’s allocation returns to the reserve the credits it has not consumed, never below what it has already consumed; those credits can then be used for another event. When an event is closed, the credits it has not consumed return to the account’s reserve.
The details of each offer, the number of free photos and the prices are published on the pricing page: they are not set by these terms.
ARTICLE 3 – YOUR ACCOUNT
Access to your account area requires an account, created with a valid email address. The account can be used as soon as it is created; an email invites you to confirm your address, and until it is confirmed, no marketing messages are sent to you and the address cannot be changed. You must provide accurate information and keep it up to date.
Your password is personal: you are responsible for it, as well as for any activity carried out through your account. Notify us without delay if you suspect that it has been used by a third party.
The service is not intended for children under 15. By using it, you represent that you are at least 15 years old or that you have the permission of the holder of parental authority.
ARTICLE 4 – THE PHOTO YOU SEND
The service works from a photo of a face, most often a selfie. This photo is personal data: sending it requires your explicit consent, which you may withdraw at any time. This consent is requested only once. When you are signed in to an account that has accepted the texts in force, or that has since checked the box, you no longer see it. Without an account — as an event guest or a photo trial visitor — you give your consent once per device, and a cookie remembers it for a limited period (30 days by default for an event guest, one year by default for the photo trial). Proof of this consent — its date and the version of the text accepted — is kept with the event for as long as the event exists. If the text you accepted changes, your consent is requested again. The conditions of its processing, its retention period and your rights are described in the privacy policy.
You may only send photos that you have the right to send. If the photo shows another person, you must have obtained that person’s prior consent: the right to their image belongs to them, and you are answerable for it. A photo of a minor requires the consent of the holder of parental authority.
At an event, each guest sends their own photo and gives their own consent. The organizer cannot consent on behalf of their guests.
ARTICLE 5 – WHAT IS PROHIBITED
You may not send or produce, through the service, any content that is unlawful, violent, hateful, discriminatory, sexual in nature, harmful to a person’s dignity, or that depicts a minor in an inappropriate manner.
You may not use a person’s image without their consent, produce an image of a public figure for deceptive purposes, or use the service in a way intended to mislead others about the authenticity of an image.
You may not infringe the rights of third parties (copyrights, trademarks), resell access to the service, automate its use by unintended means, circumvent its limits or security measures, or disrupt its operation.
We do not review uploaded photos in advance. Content that is reported or found to violate this article may be removed, and access to the service suspended, under the conditions set out in Article 8.
ARTICLE 6 – WHO OWNS THE IMAGES
The photo you send remains yours. The image produced from it also belongs to you, to the extent the law allows an automated creation to be protected: you may keep it, share it and use it freely, including for commercial purposes, subject to the rights of any third parties who appear in it.
You grant us, only for as long as necessary, the right to host and display your images in order to deliver them to you: in your account area and — for a photo taken as part of an event — in that event’s gallery, which the organizer manages.
We do not use your images for our own promotion, or to train a model, without your express and separate consent.
ARTICLE 7 – LIABILITY
We use reasonable means to ensure that the service works and that your images are delivered to you. We cannot be held liable for the content you send, for the use you make of the images produced, or for an interruption caused by force majeure within the meaning of Article 1218 of the French Civil Code.
Nothing in these terms excludes the warranties that the law grants to consumers, or any liability that cannot be limited.
ARTICLE 8 – SUSPENSION, DELETION AND TERMINATION
If you breach these terms, we may remove content, or restrict or suspend access to the account concerned. Except in the case of a serious or unlawful breach, suspension is preceded by notice and you may submit your observations.
You may delete your account at any time from “My Account”: deletion erases your photos.
A subscription may be canceled at any time from “My Account”, without notice or justification. The effects of cancellation — ending at the close of the current period, no prorated refund, unused photos lost with the subscription — are described in the general terms of sale.
ARTICLE 9 – PERSONAL DATA
The data processed by the service, the purposes of each processing operation, their legal bases, the retention periods and the ways to exercise your rights are described in the site’s privacy policy, to which these terms refer.
ARTICLE 10 – THE SITE AND THE BRAND
The site, its visual identity, its texts, its presentation visuals and the name of the service are protected. These terms grant you no rights over them: they concern the use of the service, not its ownership.
ARTICLE 11 – CHANGES TO THESE TERMS
We may amend these terms, in particular if the service evolves or regulations change. The version in force is the one published on this page; you will be notified of any substantial change. Your use of the service after publication constitutes acceptance.
ARTICLE 12 – COMPLAINTS, MEDIATION AND GOVERNING LAW
Any complaint must be sent by email to contact@partyclic.fr. We will acknowledge receipt and undertake to respond within thirty days.
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge after attempting to resolve the dispute through a written complaint; the mediator’s contact details are available upon request.
These terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction; consumers may bring proceedings, at their option, before the court of their place of residence or that of the publisher’s registered office.
