PartyClic

General Terms of Sale

ARTICLE 1 — PURPOSE AND SCOPE

These general terms of sale govern the sale, by the publisher of the PartyClic website, of photos generated by artificial intelligence, of the credits used to generate them, and of the subscriptions that provide access to these generations. They apply equally to individuals ordering for themselves and to event organizers ordering for their guests. They are the only terms of sale of the service, including the photo trial for individuals.

The full identity of the seller — company name, legal form, registered office, registration and contact details — is published on the “Legal Notice” page, which forms an integral part of these terms.

Any order placed on the site implies unreserved acceptance of these terms, in the version in force on the date of the order.

ARTICLE 2 — THE OFFERS

For individuals, PartyClic offers a free trial, whose generated photo bears the service’s logo; logo-free photos, offered when an account is created; the purchase of individual photos; and no-commitment monthly subscriptions, whose allowance is expressed as a number of photos per month.

The free trial does not require an account. The number of trials is limited per device, per connection and per day; these limits may change, and the trial may be suspended or discontinued at any time.

Creating an account is free: it requires an email address and a password. The account can be used as soon as it is created; an email invites the customer to confirm their address, and until it is confirmed, no marketing messages are sent and the address cannot be changed. The account is personal, and the number of images it can create is limited, per day and in total. The free logo-free photos are counted per email address: deleting an account and recreating it with the same address does not renew them.

A single-photo purchase unlocks the logo-free version of one photo only, the one for which it is made. A subscription entitles the customer to a number of photos per month, unlocked one at a time; it renews each month until it is canceled.

The photos in an account are kept there for as long as the account exists, or until the customer deletes them. The retention periods for other photos, including trial photos not linked to an account, are set out in the privacy policy.

For event organizers, PartyClic offers plans, whose scope is described on the pricing page, and credit packs purchased online from the organizer area.

Credits are held in the reserve of the organizer’s account, and the organizer allocates them to each of their events. Lowering an event’s allocation returns to the reserve the credits it has not consumed, never below what it has already consumed; those credits can then be used for another event. When an event is closed, the credits it has not consumed return to the account’s reserve. An event that the organizer has not closed is closed automatically: 7 days after it ends, the event is closed and its unused credits return to the reserve.

The allowance of each offer, the number of photos offered upon registration and the prices are not set by these terms: they are published on the site’s pricing page. The offers and prices in force are those displayed there at the time of the order.

ARTICLE 3 — PRICES

Prices for offers intended for individuals are stated in euros, all taxes included (TTC). Credit packs, purchased online from the organizer area, are sold at the tax-inclusive price displayed before payment, whoever the customer is: no tax is added at the time of payment, and automatic top-up charges the same price. Plans intended for event organizers, including annual licenses, are not sold online: they are provided on a quote basis, exclusive of taxes (HT).

No delivery fees are charged: photos are delivered in digital form, in the customer’s account.

PartyClic may change its prices at any time. The price applicable to an order is the one displayed when the customer confirms it or, for a plan provided on a quote basis, the price in the accepted quote. For an ongoing subscription, a price change applies only from the next renewal date, and after the customer has been informed.

ARTICLE 4 — ORDER AND PAYMENT

Orders are placed online, on the site, after the customer has reviewed the details of the chosen offer and its price.

Payment is made online through the payment provider Stripe: by bank card, Apple Pay, Google Pay and the other methods offered on Stripe’s secure payment page, including, where offered, deferred or installment payment, such as Klarna, subject to the terms of its provider. Payment data is entered and processed by Stripe alone: it does not pass through the service, and no card data is stored by PartyClic.

The order becomes firm and final when payment is collected. A confirmation is then sent to the customer at the email address of their account.

ARTICLE 5 — RIGHT OF WITHDRAWAL

A consumer customer in principle has fourteen days (14 days) from the order to exercise their right of withdrawal, without having to give reasons or bear any costs.

However, pursuant to Article L. 221-28 13° of the French Consumer Code, this right is lost for the supply of digital content not provided on a tangible medium whose performance has begun before the end of the withdrawal period, provided that the customer has given express consent to this immediate performance and has acknowledged losing their right of withdrawal.

A logo-free photo, a subscription and a credit pack, supplied upon payment, fall within this case, as does the automatic top-up of credits, for which consent is obtained when the payment method is saved. The customer’s express consent to their immediate performance and waiver of the right of withdrawal are obtained through a checkbox, never pre-checked, on the payment page, before paying: unless this box is checked, payment cannot be completed. Once the photo has been unlocked or the subscription has started with this consent, the payment is not refunded under the right of withdrawal.

Where this consent has not been given, the consumer customer may exercise their right of withdrawal within the fourteen-day period, by simple request sent to contact@partyclic.fr.

ARTICLE 6 — REFUND POLICY

A photo that has been paid for but not delivered — a generation that fails, is interrupted or is never returned to the customer — is refunded automatically, without any action on the customer’s part: the corresponding credit is restored, or the amount paid is returned using the payment method used for the order.

Any other refund request must be made by email to contact@partyclic.fr, stating the date of the order and the address of the account concerned. It is reviewed on a case-by-case basis; any refund granted is made using the payment method used for the order.

ARTICLE 7 — CANCELLATION AND TERMINATION OF SUBSCRIPTIONS

Subscriptions are taken out with no minimum term. They may be canceled at any time from “My Account”, without notice or justification.

Cancellation takes effect at the end of the current, already-paid period: the customer retains access to their offer until that date, and no further charges are made afterward. The current period is not refunded, even in part; no prorated refund is due.

Photos unused at the end of a monthly period are carried over to the next period, up to one month’s worth of photos, for as long as the subscription lasts; they end with it and do not give rise to any refund.

If “My Account” is not accessible, cancellation may be requested by email to contact@partyclic.fr. Deleting the account cancels the subscription immediately, before the account is erased.

ARTICLE 8 — TERM, AVAILABILITY AND FORCE MAJEURE

These terms apply for as long as the service is online. The service is available continuously, subject to the interruptions required for its maintenance and to failures of networks and technical providers; scheduled interruptions are announced in advance whenever possible.

The seller cannot be held liable in the event of force majeure within the meaning of Article 1218 of the French Civil Code. If such an event permanently prevents the performance of an order that has already been paid for, that order is refunded.

ARTICLE 9 — LEGAL WARRANTY

Independently of these terms, the consumer customer benefits from the legal warranty of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code, as well as from the legal warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The legal warranty of conformity is exercised at no cost to the customer. To invoke it, the customer simply needs to submit a request to the contact address given in Article 10, describing the defect found.

ARTICLE 10 — COMPLAINTS

Any complaint relating to an order, a photo or a subscription must be sent by email to contact@partyclic.fr, stating the date of the order, the address of the account concerned and the subject of the request.

The seller acknowledges receipt of the complaint and undertakes to respond within thirty days of its receipt.

ARTICLE 11 — CONSUMER MEDIATOR

In accordance with Articles L. 611-1 et seq. of the French Consumer Code, the consumer customer may use a consumer mediator free of charge with a view to the amicable resolution of a dispute, after having attempted to resolve it directly through a written complaint.

The contact details of the competent consumer mediator are available upon request at the contact address given in Article 10.

ARTICLE 12 — PERSONAL DATA

Personal data collected in connection with an order is processed under the conditions described in the site’s privacy policy, to which these terms refer. There the customer will find the purpose of each processing operation, the retention periods and the ways to exercise their rights.

ARTICLE 13 — GOVERNING LAW AND JURISDICTION

These general terms of sale are governed by French law. Failing an amicable resolution, the French courts have jurisdiction. The consumer customer may bring proceedings, at their option, before the court of their place of residence or that of the place where the seller has its registered office.

ARTICLE 14 — CHANGES TO THE TERMS

The seller may amend these general terms of sale at any time. The version applicable to an order is the one published on this page on the date the order is placed; the most recent version is available on this same page.
